What are my rights as a tenant or landlord?

South African rental relationships are governed by the Rental Housing Act and the lease agreement. Tenants have the right to a habitable property, privacy, and fair treatment. Landlords may not evict tenants without a court order and must maintain the property. Both parties must adhere to the terms of their lease, and disputes can be referred to the Rental Housing Tribunal. If the tenant does not comply with the terms of the lease, her or she may be evicted. Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 would apply.
