    Can you please assist me, I have been receiving maintenance money from Court. Since they have changed the payment system that now the money must be paid directly into my account not via court, I don’t receive it anymore. I have submitted my banking details and everything but nothing it’s been 7months now. When I went to court to do follow up they tell me that they don’t have an invitation officer to go deliver the document to the father of my child, since the court can’t get hold of His Hr. I really don’t Know what to do anymore.

  6. Good day. I need to find out where I stand and what should I do. My ex husband and I have two girls 13 and 10 and we share custody. He sees them every second weekend. He never had issues with paying maintenance. He told me he lost his job in May and stopped paying. He promised he will catch up as soon as he finds a job so I waiting. I am a teacher and I do struggle on my salary with two kids. He recently got engaged to a lady who apparently doesnt work either. My daughter confirmed after weekend with them that they have booked a huge venue, have wedding rigs, dress etc. We all know how much money it takes. I have a feeling he is doing jobs on a side and getting paid cash and lies to me so I do not ask for money. Can I approach a maintenance court without a legal representative? I cannot afford one. If they ask him for his bank statement and it will show that he indeed have no income, can they question him for proof who pays for the wedding? He also said he wants to move to Ireland in search for job but I have a feeling he wants to run away from responsibilities. How long will I wait for court date if I do go to maintenance court with this case?

      Yes, you may approach the maintenance and they should act as you suggested. You do not need a lawyer. They will ensure that all information is disclosed. Each court is different regarding their caseload. They would advise you accordingly.

Hi,I’ve just filed for maintenance and I was given a court date.It won’t actually be my first appearance as I appeared last time and there was a postponement due to the monthly amount disagreement. Me and my husband are married for 14 years we’ve got a child together of the age of 13. 6 years ago I become a diabetic using insulin and had heart failure 4 years ago so I’m not healthy. I want to know if I can sue the court for the stress and problems and losses I had to go through. Now I get told that the clerk is doing 3 people’s job.     My name is Noxolo and I have a son who is turning 4 years old in june and I am 26 years old, I would like to be advised on how to claim maintanance from the father because he says he is doing a learnership and I am also doing a learnership but I do everything I can for my son and most of the time I do everything for him, in the beginning when our son was still a new born baby and we were together he used to do everything for him but since we broke up he stopped doing things for him and waits for me to beg for him to do things for him and he does not even make time to see him or even call him can I please get advise on how to go about this im really stressed and confused.

  16. I have a 4month daughter with a man who refuses to support her in any way. I have on many occasions tried reaching out to him to get him to commit to atleast something which he has countlessly failed to do. He insists on dna testing as he denies the child but will not commit to doing it… I have even gone as far as voluntaring to meet him half way after contacting a paternity testing facility. The problem I’m having now is that my daughter’s birth certificate is still pending at home affairs because i was subjected to a late registration because of personal reasons and then told it would take up to 6months for them to issue it out. I registered her when she was a month old.

    My biggest issue right now is that I need financial assistance from him and I was told when I went to the family court that nothing can be done without the birth certificate.

    I wanted to know if there could be another way to deal with this whole situation or better getting a court order that would subject him to actually taking the dna test so he can at least commit to supporting our daughter while we wait for the birth certificate? I just wanted to get advice or a way forward.

      The Court should still assist you even though you do not have the birth certificate.
      When the father appears in court, and he says he is not the father, he would then go for a paternity test.

Good day ,i have filled a maintanace for two kids, at Atteridgeville court in Pretoria in 2017 April, first appearance was in September 2017, till this day am going up and down summoning my ex husband with dates, last 2018 August they have sent a garnish to his work and the verdict was he’s on contract they cannot garnish the persons, if I cannot be help by the court where should I go now.

    1. Good day. It seems to me that the maintenance court is not trying really hard to assist you in your matter. It may be a good idea to lodge a complaint on to someone higher than the maintenance officer.

      The father of your child still has a legal duty to maintain his child even if you earn more than him. His contribution may, however, be less. But the court would decide based on the facts of your case. We advise you approach the maintenance court as soon as possible.

    1. If the Court order says you may pay each month, then you must. If there is no Order in place, you need to discuss this issue with the mother. She my have monthly expenses for the kids during that time. That is likely.
